Welcome to Kimu. These Terms of Service (the “Terms”) are a legal agreement between you and Anmar Aljarad, the operator of the Kimu mobile application and related services (collectively, “Kimu,” the “Service,” “we,” “us,” or “our”). By creating an account, or by accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Community Guidelines, which are incorporated by reference. If you do not agree, do not use the Service.
Please note: Section 15 contains a limitation of liability, and Section 17 sets out the governing law and how disputes are resolved. These affect your legal rights — please read them.
You must be at least 13 years old to use Kimu. If you are under the age of majority where you live (typically 18), you may use Kimu only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. If you are located in the European Economic Area, the United Kingdom, or another region with a higher minimum digital-consent age, you must meet that age or have verifiable parental consent. The Service is not directed to, and we do not knowingly allow, children under 13.
By using Kimu you represent that you meet these requirements and that you are not barred from using the Service under the laws of your jurisdiction.
Kimu is a social platform for fans of K-pop. It lets you create a profile, publish posts (text, images, and video), comment, send direct messages, follow other users, “stan” idols and groups, send and receive in-app appreciation (“Sarang”), earn and exchange in-app points, and browse content about idols, groups, and events. The Service also surfaces publicly available media and information about K-pop idols, groups, and events that we aggregate from third-party sources.
Kimu is an independent fan platform. It is not affiliated with, authorized, sponsored, or endorsed by any idol, group, agency, label, or rights holder. Names, images, and information about public figures are presented for the purpose of fan community and commentary.
You can create an account using an email address and password, or by signing in with a supported third-party provider (Apple, Google, Kakao, or Naver). You agree to provide accurate information and to keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us at support@kmoonproject.com if you suspect unauthorized use.
You may hold only one account unless we expressly permit otherwise. You may not sell, rent, transfer, or share your account, and you may not impersonate any person or misrepresent your affiliation with anyone.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the Kimu app on devices you own or control, for your own non-commercial use. We reserve all rights not expressly granted.
“Your Content” means anything you post, upload, or transmit through the Service — including text, photos, videos, comments, and messages.
You keep ownership of Your Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, adapt (for example, to create resized image versions), publish, publicly display, and distribute Your Content solely for the purpose of operating, providing, and improving the Service. This licence ends when you delete Your Content or your account, except (a) for content others have re-shared or saved, (b) where retention is required by law, and (c) for residual copies in routine backups, which are purged on the schedule described in our Privacy Policy.
You represent and warrant that you own or have the necessary rights to Your Content and that it does not infringe anyone’s rights or violate any law or these Terms.
Images and videos are publicly accessible. Media you upload (such as profile pictures, post images, and videos) is served from public content-delivery storage. This means a file can be viewed by anyone who has its direct link, even outside the app. Do not upload anything you are not comfortable being public.
You agree to follow our Community Guidelines. Among other things, you must not: harass, bully, threaten, or hate-speech others; post sexual content, or any content that sexualizes minors (zero tolerance); post illegal, violent, or self-harm-promoting content; spam, scam, impersonate, or run bots or fake-engagement schemes; post private or personal information about others (doxxing); infringe intellectual-property or privacy rights; or interfere with, scrape, reverse-engineer, or attempt to gain unauthorized access to the Service. We may remove content and suspend or terminate accounts that violate these rules.
Kimu includes virtual items, including “Sarang” (an in-app appreciation currency) and “Points” (earned in-app). You may acquire Sarang for free (for example, through daily rewards or invitation rewards) or by purchasing it through the app stores.
The Service displays content about idols, groups, and events that we collect from publicly available third-party sources, and it integrates third-party sign-in and other services. We do not control and are not responsible for third-party content, websites, or services, and their inclusion is not an endorsement. Your use of a third-party service (such as a social login provider or an app store) is governed by that provider’s own terms and privacy policy.
The Service itself — including the Kimu name, logo, software, design, and original text and graphics — is owned by us or our licensors and is protected by intellectual-property laws. Except for Your Content and the limited licence in Section 4, nothing in these Terms grants you any right in our intellectual property.
We respect intellectual-property rights. Some content on Kimu — including photos that appear on idol and group profiles — is submitted by our users. We respond to valid notices of alleged infringement and remove infringing material.
Filing a notice. If you believe content on Kimu infringes your copyright, send a notice to our Designated Copyright Agent (below) including: (1) your contact details; (2) identification of the copyrighted work; (3) the specific content and where it appears in the app; (4) a statement that you have a good-faith belief the use is unauthorized; (5) a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act for them; and (6) your physical or electronic signature. You can also report a specific image directly in the app (tap the photo → Report).
Designated Copyright Agent. Pursuant to 17 U.S.C. § 512(c), Kimu’s Designated Copyright Agent to receive notifications of claimed infringement is:

Counter-notice. If your content was removed in error, you may submit a counter-notice to the same address with the information above.
Repeat-infringer policy. It is our policy, in appropriate circumstances, to disable or terminate the accounts of users who repeatedly infringe the copyrights of others. We record a strike against an account each time we remove infringing material it submitted, and an account that accumulates repeated valid complaints will be deactivated.
We may review, remove, or restrict content and may suspend or terminate accounts that violate these Terms or the Community Guidelines, that create legal risk, or that harm the Service or other users. Where reasonable and lawful, we will try to give notice, but we may act immediately for serious violations.
You may stop using Kimu at any time and may delete your account from Settings → Account → Delete Account, or as described on our account-deletion page. Deletion is immediate and permanent. Sections that by their nature should survive termination (including Sections 5 (as to existing copies), 7, 9, 13–17) will survive.
We are continually developing Kimu and may add, change, or remove features, or suspend or discontinue the Service in whole or in part, at any time. We will not be liable to you for any such change, except as required by law.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free, that content is accurate, or that defects will be corrected. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amount you paid us, if any, in the twelve months before the claim, or (b) USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.
To the extent permitted by law, you agree to indemnify and hold harmless Anmar Aljarad and the Service from any claims, damages, losses, and reasonable expenses (including legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules, and the competent courts of the United Arab Emirates will have jurisdiction over any dispute — except that this does not deprive you of the protection of mandatory consumer-protection laws of the country where you live, and you may also be entitled to bring proceedings there.
Informal resolution first. Before filing any claim, please contact us at support@kmoonproject.com so we can try to resolve it. Most concerns can be settled this way.
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and us regarding the Service.
